Terms of Use for Tay Than Thar Music

I. SERVICE

Tay Than Thar Music streaming service is provided and operated by East Boy Engineering Co., Ltd. Subscribers of Tay Than Thar Music streaming service need to use the service according to our Terms of Use. Your continuation of using the service constitutes your agreement to the Terms, which may be updated by us from time to time without prior notice. You can review the most current version of the Terms of use at any time at https://www.taythanthar.com/ portal and East Boy Engineering Co., Ltd reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently. But East Boy Engineering Co., Ltd and/ or MPT will not have any responsibility for that. East Boy Engineering Co., Ltd and/ or MPT and their members will not have any responsibility for any loss or damage of your welfare (including your personal data and cash) directly or indirectly (OR) unable to get Tay Than Thar Music streaming service due to your carelessness while getting Tay Than Thar Music streaming service by registration. Detail Terms of Use are as follow.

1. Registration to be a member

We may require you to register or otherwise provide information about yourself in order to use Tay Than Thar Music application or certain of its functionalities. You agree to provide current, true, accurate and complete information about yourself as prompted by the Service. You consent and agree that Tay Than Thar Music may access, preserve and disclose your user data provided during registration if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to provide the Service to you and to respond to your request for customer service, comply with legal process, enforce the Terms, respond to claims that any description violates the rights of third parties and to send the information about the Service to you. By registration for Tay Than Thar Music streaming service, you accept and agree to be sent all information in the form of SMS and SMS link concerned with this Service.

2. Service Fee

It will cost 99 kyats (including 5% commercial tax) per day to listen/stream Tay Than Thar Music Streaming Service with smartphones & tablets.

Charging frequency is daily charging with 365 days package. The validity period of a Subscription-type Service is 365 days.

CRBT(Call back Ring Tune),Download for off-line listening and Gift song will cost 300 kyats (+ 5% commercial tax) per song. You will need to pay separately for above services.

If you have insufficient balance, you will not be charged. If is you couldn’t be charged for any reason, you will not be able to use the Service on that day.

Charging and use of Service will resume when you have sufficient balance.

There is no retroactive charging. You will not be charged for days when you are not charged for any reason.

The Subscription will be automatically terminated if you are not charged for 90 consecutive days from the last date of successful charge.

You have to pay for full service fee from your phone bill as per your usage. If you are an MPT prepaid user, we will deduct service fee from your prepaid phone bill. If you are an MPT post-paid user, MPT will calculate and collect service fee when you pay for your phone bill. These service fees are only for subscribing Shal Game service.

Additional Data charges may apply for your browsing and streaming of Tay Than Thar Music ‘s content. Please note that all charges include 5% Commercial Tax.

You are responsible for the actions of any third party with whom you are sharing your mobile internet including, but not limited to, Subscription to the Service.

These Terms are valid until you unsubscribe or until the Service is automatically terminated pursuant to these Terms.

3. Billing

You agree and accept us to charge you daily subscription fee for using Tay Than Thar Music streaming service from registered MPT phone bill. And you also agree to pay for necessary taxes. Daily subscription fee 99 kyats (including 5% commercial tax) will start billing to your MPT phone bill and it will be charge recurring daily until you un-subscribe to the service. We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Any price changes to your service will take effect only after an SMS notice to you by Tay Than Thar Music. Payments are nonrefundable and Tay Than Thar Music does not commit to provide refunds or credits for any reason. If you subscribe daily subscription, your Tay Than Thar Music subscription will continue in effect on a day to day basis unless and until you cancel your subscription or we terminate it.

If anyone else not you or any organization that you know or not is using your phone (OR) using your Sim Card (OR) using Sim Card registered with your personal information have subscribed Tay Than Thar Music streaming service, we will bill subscription fee.

4. Service

You have to pay 99 Kyats (including 5% commercial tax) Daily Subscription fully to use Tay Than Thar Music streaming service. You agree to use this service to entertain for your personal enjoyment/ use only. You are allowed to access audios and videos such as all digital contents, registered device for personal, non-commercial purposes during your subscription. You acknowledge that if during subscription period you stop using Tay Than Thar Music App, the distributor from whom Tay Than Thar Music licenses the content requires Tay Than Thar Music to withdraw the musical content (meaning we cannot play it anymore), you may not be able to continue to access and play some of the musical content as it may self-destruct, and, to the full extent permitted by law, in that event Tay Than Thar will not have any liability to you.

You also agree that we can make advanced test and play audios, videos, Content and other information. Tay Than Thar Music reserves the right to make advanced testing, playing, cancelling, and terminating subscription concerned with the content in Tay Than Thar Music with its sole decision.

5. Un-subscription/ Cancellation

If you would like to unsubscribe our service, you can unsubscribe by sending SMS message OFF to 8734, by pressing unsubscribe option in the Tay Than Thar Music application or by calling Customer Care Service. You agree that East Boy Engineering Co., Ltd may in its sole discretion, suspend or terminate your account and/ or access to the Service and/ or billing for no reason, without notice. You acknowledge and agree that under no circumstances will East Boy Engineering Co., Ltd be liable to you or any third party in any suspension, termination, cancellation or un-subscription.

6. Devices

You can use our service via smartphones and tablets with compatible technology and operation systems. If you cannot use our service even you have already subscribed our service due to underperformance of your devices or if your devices are not compatible with our lowest specifications, you have need to pay for you the service fee. Thus, you may need to check whether your devices are compatible to use Tay Than Thar Music or not. East Boy Engineering Co., Ltd will not take responsibility for you cannot use our service under the circumstances of you are using underperformance devices or incompatible devices. The quality of the audios and videos content may vary from device to device (depending on where you are accessing and Streaming Tay Than Thar Music application from), and may be affected by a bunch of factors, such as your location, the bandwidth available and/ or speed of your internet connection. To use Tay Than Thar Music streaming service, you need to subscribe our service as per our statement of lowest devices and software specification occasionally. We will not take responsibility for the problems or issues due to devices and software that are not compatible with our lowest specification.

7. Sending Notifications

By using Tay Than Thar Music streaming service, you agree to receive notifications send from our service and/ or to get a contact to your registered phone number from Tay Than Thar. We may notify you about new songs, new videos, live concerts, new plans, promotion plans or collect user survey data via Tay Than Thar Web Portal, SMS or other ways of communication. Moreover, you agree to receive notifications of payment bill for streaming music tracks, agreements, statements, announcements and other information sent by Tay Than Thar Music. We may provide the means for you to submit information, data, text, software, sound, photographs, graphics, videos, messages, tags or other materials to Tay Than Thar Music streaming service. You are solely responsible for any description that you submit while registration process and the consequences of submitting it.

8. Restrictions

You don’t have right to use Tay Than Thar music streaming service for commercial purposes. Tay Than Thar music streaming service is for your personal and noncommercial use only. You agree to use Tay Than Thar music streaming service as per these Terms of Use legally.

You agree not to access the service (1) by any means other than through the interface that is provided by Tay Than Thar for use in accessing the service, (2) through any automated means (including the use of any Robot, Spider, Scraper, Script or Web Crawler) or (3) by forging or manipulating identifiers in order to disguise the origin of any access to the service, (4) by using any software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any Tay Than Thar music streaming service, (5) by uploading, posting, writing e-mail or using any software viruses by the intention of interfere with Tay Than Thar music streaming service.

You have to agree Tay Than Thar Music streaming service within our Terms of Use and restrictions. You agree to use Tay Than Thar music streaming service without breaching or breaking our Terms of Use, restrictions, rules and regulations and beyond our limitations. And you are not allowed to use Than Thar Music’s social media pages such as Facebook page, Instagram, YouTube and Web Page without permissions of Tay Than Thar Music streaming service.

9. Intellectually Property Rights

The term Tay Than Thar and all of the trademarks used in Tay Than Thar Music streaming service (including the name of Tay Than Thar and other trademarks), logos, business names and service names are the exclusive trademarks of and are owned by East Boy Engineering Co., Ltd and East Boy Engineering’s business partners and other related companies. Any third party trademarks or service marks displayed on the service are the property of their respective owners. The chance we gave to you for using our service is not including the right or usage of those trademarks, logos, business names and service names. You will have the right to use those chances only when you have the legal authorization letter of East Boy Engineering Co., Ltd, its suppliers and its business partners. You don’t have the right to use for referring Tay Than Thar music streaming service or anything else.

10. Liability Disclaimer

In no event shall East Boy Engineering Co., Ltd, MPT, their members, staffs, representatives, business partners, owners of copyright or patent be liable to you or any third party for breaking the Terms of Use, any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with your use of, or inability to use, the service or any information, software, products, services, third party dealings, or description obtained or accessed through the service, whether based on contract, tort, strict liability or otherwise. You acknowledge and agree to take sole responsibility and take action for all cases.

11. Declaration

Above Terms of Use are legal. We regard that you acknowledge and agree to all of these Terms of Use by using, visiting, or browsing the Tay Than Thar Music streaming service. It will be your sole responsibility for using Tay Than Thar Music streaming service without reading our Terms of Use.

12. Governing Law & Jurisdiction

All of above Terms of Use shall be governed by and construed in accordance with the laws of Myanmar, and you agree to consent to jurisdiction of the competent Myanmar Courts.
